1. Who we are and what this agreement covers

outty.co (the "Site") is operated by Outty ("Outty", "we", "us", "our"). These Terms and Conditions (the "Terms") form a binding agreement between you and us and govern your access to and use of the Site and any related content, features, accounts and services (together, the "Services").

By accessing or using the Services you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

We may update these Terms from time to time. Material changes will be reflected by a revised effective date at the top of this page. Continued use of the Services after an update means you accept the revised Terms.

2. Outty is a discovery and referral service, not a travel supplier

Outty is an editorial discovery marketplace. We catalog, describe and rank tours, attractions, tickets and activities so travelers can compare them, and we score each experience 0 to 100 with the Outty Ranking.

We do not own, operate, control, staff, supervise, insure or inspect any tour, attraction or activity listed on the Site. We are not a tour operator, travel agent, carrier, ticket seller or merchant of record for any experience.

Bookings are not completed on Outty. When you choose to book, you leave the Site and complete your purchase on Viator, which acts as the booking platform for the third-party supplier that actually provides the experience. That transaction is governed by Viator's terms and by the supplier's own booking, cancellation and safety policies, not by these Terms.

3. Third-party bookings, suppliers and Viator

All contractual rights and obligations relating to a booking, including payment, confirmation, changes, cancellations, refunds, no-shows, delivery of the experience, safety and any dispute about the experience, exist between you, Viator and the supplier of that experience. Outty is not a party to that contract.

You are responsible for reading the supplier's inclusions, exclusions, meeting instructions, age and health requirements, accessibility information, and cancellation policy before you book, and for meeting any passport, visa, insurance, vaccination, licensing or fitness requirements that apply to you.

Requests for refunds, rescheduling, receipts, complaints or service recovery must be made through Viator or the supplier. We cannot issue refunds, modify a booking or guarantee a supplier's performance.

4. Affiliate disclosure and how we make money

Outty participates in the Viator affiliate program. When you click through from the Site and complete a qualifying booking, we may earn a commission from Viator. This costs you nothing extra: the price you pay is the price Viator and the supplier set.

Commission rates are not an input to the Outty Ranking, and no supplier can pay for a higher score, a badge, entry into the 90+ Club, or preferential placement in ranked results. If we ever run paid placement, it will be labeled as advertising on the page and excluded from ranked results. Our editorial rules are published in full on our editorial standards page.

Some links on the Site are affiliate links. Their presence does not change our assessment of any experience.

5. Content, pricing and availability accuracy

Descriptions, images, itineraries, inclusions, logistics, operating days, ratings, review counts, durations and prices shown on the Site are sourced primarily from the Viator Partner API and are refreshed on a schedule. They can become out of date between refreshes and can differ from what a supplier displays at the moment you book.

Prices are typically "from" prices: the lowest available option at the last refresh, before taxes, fees, add-ons and date-specific pricing where applicable. The price presented at checkout on Viator is the authoritative price. Availability shown on the Site is indicative and does not reserve anything.

The Outty Ranking is an editorial opinion produced by a model. It is not a guarantee of quality, safety, suitability or satisfaction, and it should not be your only basis for a booking decision.

We provide the Services on an informational basis and do not warrant that any listing is complete, current, accurate or error free.

6. Accounts

Some features require an account. You must provide accurate information, keep your credentials confidential, and are responsible for activity that occurs under your account. You must be at least 16 years old, or the age of digital consent where you live if that is higher, to create an account.

Notify us promptly if you believe your account has been accessed without authorization. We may suspend or terminate an account that we reasonably believe violates these Terms, creates risk or legal exposure, or is used for fraud or abuse.

7. Acceptable use

You agree not to: use the Services for any unlawful purpose; scrape, crawl, harvest, mirror or bulk download Site content except as permitted by our robots.txt; circumvent rate limits, access controls or security measures; resell, sublicense or commercially redistribute our content, rankings or data; reverse engineer any part of the Services; interfere with or overload our infrastructure; impersonate any person or entity; upload malicious code; or use automated systems to place fraudulent or speculative booking clicks.

You also agree not to use our content to train, fine-tune or ground a commercial model in a way that reproduces our rankings or catalog at scale without our written permission, except where such use is expressly permitted by applicable law.

8. Intellectual property

The Site, the Outty name and marks, the Outty Ranking methodology, our editorial text, page structure, compilation and arrangement of listings, and our software are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your own personal, non-commercial travel planning.

Supplier names, product names, photographs and descriptions remain the property of their respective owners and are displayed under the terms of our data license with Viator.

If you believe content on the Site infringes your rights, contact us with enough detail to identify the work, the URL, and your contact information, and we will investigate and remove or correct material where appropriate.

9. Third-party links and services

The Services link to third-party websites and services, including Viator and supplier websites. We do not control and are not responsible for their content, policies, availability, security or practices. Accessing them is at your own risk and subject to their terms.

10. Disclaimer of warranties

To the maximum extent permitted by law, the Services and all content are provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy and non-infringement.

We do not warrant that the Services will be uninterrupted, secure or error free, that defects will be corrected, or that any listing, price, rating, score or availability is accurate or current. We make no warranty regarding the conduct, safety, qualifications, licensing, insurance or performance of any supplier.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

11. Limitation of liability

To the maximum extent permitted by law, Outty and its members, managers, officers, employees, agents and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, lost bookings, personal injury, property damage, trip disruption, or costs of substitute services, arising out of or relating to your use of the Services or any experience booked through a third party, whether based in contract, tort, strict liability, statute or otherwise, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Services will not exceed one hundred U.S. dollars (USD 100).

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by our negligence.

12. Indemnification

You agree to indemnify and hold harmless Outty and its members, managers, officers, employees and agents from any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of your use of the Services, your violation of these Terms, your violation of any law, or your interaction with any supplier or third-party booking platform.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute that is not otherwise resolved, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.

Disputes about a booking, a payment or the delivery of an experience are handled under Viator's terms and the supplier's terms, not here.

If you are a consumer resident in the European Union, the United Kingdom or another jurisdiction whose mandatory consumer protection law grants you rights that cannot be waived, nothing in this section deprives you of those rights or of the right to bring proceedings in your place of residence.

14. General

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect and the unenforceable provision is modified to the minimum extent necessary. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Services.

We may modify, suspend or discontinue any part of the Services at any time. We may terminate your access for any violation of these Terms. Sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, indemnification and governing law, survive.
